Kinderberry Hill Child Development, KHCDI, Inc., KHCDII, Inc., and KHCDIII, Inc., together with its subsidiaries and affiliates (collectively “KBH”, “our” or “we”) is committed to protecting your and your child’s privacy, which is why we have adopted this Privacy Policy. This Privacy Policy lets you know how and for what purposes your and your child’s personal information is being collected, processed and used. We promise that we will take reasonable steps to ensure that your and your child’s personal information will only be used in ways that comply with this Privacy Policy. As used in this Privacy Policy, “child” shall mean child or children, as applicable, and shall refer to each of your children and/or any of your children, as applicable.
Kinderberry Hill owns and operates early learning educational schools (each a “School”).
This Privacy Policy is in effect for the collective non‑user-specific information and personal information received, collected and/or owned by KBH, including information provided to KBH thru its Schools. Your use of any web pages, mobile applications, third party social media sites, email lists, online features, services and/or programs offered by KBH (collectively, the “Website”) is governed by this Privacy Policy. Your use of the Website is also governed by Terms and Conditions located at www.KinderberryHill.com.
This Privacy Policy is not applicable to any other web pages, mobile applications, third party social media sites, email lists, collective non‑user-specific information and collective personal information collected and/or owned by any entity other than Kinderberry Hill.
Types of Information Kinderberry Hill Collects or Receives
Kinderberry Hill stores and uses the information that we collect or receive in compliance with applicable state and federal law. The types of personal information Kinderberry Hill collects or receives may include: (1) names; (2) mailing addresses; (3) email addresses; (4) home and/or mobile telephone numbers; (5) date of birth; (6) health assessments, medical condition information, allergy information, medication information and immunization status; (7) injury, behavioral, accident, incident and illness reports, including, but not limited to, crime and police report information; (8) scholastic performance data; and (9) other information provided by Kinderberry Hill. The means by which Kinderberry Hill collects or receives such personal information may include when you: (1) request information about a School through the Website; (2) access a Kinderberry Hill social media platform; (3) sign up for email notifications, electronic newsletters, mobile messages (including SMS), or social media notifications from Kinderberry Hill or its Schools; (4) provide Kinderberry Hill with comments, suggestions or other input through the Website or otherwise; and (5) provide information to Schools. We may also receive information from third parties that provide us with such information, including as part of any investigation or inquiry that we may undertake.
School Collected Information
As a part of enrollment and providing you with services, Schools may collect and receive, and are continually collecting and receiving, personal information about you and your child. The information collected by Schools is often stored on certain Kinderberry Hill’s secured servers and other times is transmitted directly to our employees and agents for a specific purpose.
Website Information Collected
Kinderberry Hill may collect two types of information when you visit or use the Website: contact information and usage information.
Contact Information
Contact information refers to the information that you intentionally provide to us when you submit a request to be contacted. This information may include your name, address, phone number, email address, child’s name and child’s date of birth, as well as any other information that you may voluntarily provide through the Website. We collect this information for purposes of responding to requests for more information about Kinderberry Hill and its School(s). When you submit contact information, you accept that this information will be shared with Schools.
Usage Information
KBH may obtain non-individualized, generic information about you when you visit the Website.
Browser Log Files
Our servers automatically log each visitor to the Website and collect and record certain information about each visitor. This information includes or may include your “Internet Protocol”, or IP, address, browser language, browser type, operating system, domain names, browsing history (including time spent at a domain, time and date of your visit), referring/exit web pages and URLs, and number of clicks. The domain name and IP address reveal nothing personal about the user other than the IP address from which the user has accessed the Website. We may use this information to examine our traffic in the aggregate, but do not collect and evaluate this information for individuals.
Cookies
From time to time, Kinderberry Hill and/or our advertisers or other third parties may send a “cookie” to your computer. A cookie is a small piece of data that is sent to your Internet browser from a web server and stored on your computer’s hard drive. A cookie, by itself, cannot read data from your hard disk or read cookie files already on your computer. A cookie, by itself, does not damage your system. Web Beacons
Some of our web pages and electronic communications may contain electronic images known as Web Beacons (sometimes referred to as “clear gifs”). Web Beacons collect only limited information that includes a cookie number; time and date of a page view; and a description of the page on which the Web Beacon resides. We may also carry Web Beacons placed by third party advertisers. These Web Beacons do not carry any personally identifiable information and are only used to track usage of the Website and activities associated with the Website.
Unique Identifier
We assign you a unique internal identifier to help keep track of your future visits. We use this information to gather aggregate demographic information about our visitors, and we use it to personalize the information you see on the Website and some of the electronic communications you receive from us. We keep this information for our internal use, and this information is not shared with others. This information is in no way tied to your personal information, including your email address.

Information collected or received by Kinderberry Hill is used for five main purposes. First, we collect information to provide you services and improve your and your child’s experience with Kinderberry Hill and the Schools, as well as the Website. Second, we may now or in the future collect information to personalize the experience of the users of the Website. Third, we collect information to communicate with you and to inform you about the Schools and the products and services of Kinderberry Hill. Fourth, we use information collected about and from parents and students at Schools, and visitors to the Website, for our internal business purposes (e.g., business planning, program development and future school locations). Finally, we may collect or otherwise receive information about you or your child for the purpose of giving you additional information about Kinderberry Hill and a School geographically convenient to you.
When Information Is Disclosed By Kinderberry Hill
In addition to the other times or occasions on which we might disclose information, we might also disclose information when required by law or in the good-faith belief that such disclosure is necessary to: (1) comply with a legal process and applicable laws; (2) enforce this Privacy Policy; and/or (3) investigate and/or protect the rights, property or personal safety of you, your child, Kinderberry Hill, our employees, or the public.

We reserve the right to transfer your personally identifiable information, as well as any other information, in connection with the sale or other disposition of all or part of the Kinderberry Hill business and/or assets. We also cannot make any representations regarding the use or transfer of your personally identifiable information or other information that we may have in the event of our bankruptcy, reorganization, insolvency, receivership or an assignment for the benefit of creditors. Furthermore, we cannot and will not be responsible for any breach of security by any third parties or for any actions of any third parties that receive any of the information that is disclosed by us.
Employment Opportunity Information Collection
For individuals interested in job opportunities with Kinderberry Hill, the Website currently or may in the future allow prospective employees to request additional job opportunity information. The Website may be used to collect personal information from prospective employees for human resources recruitment purposes. The foregoing described information is then shared with others within Kinderberry Hill who are involved in the recruitment process. The foregoing also applies to job application inquiries that you may transmit to us other than through the Website.
Privacy Outside the Website
The Website may contain various links to other websites, including links to various third party service providers. Kinderberry Hill is not and cannot be responsible for the privacy practices or the content of any of the foregoing described websites. Choices With Your Personal Information
Whether you submit personally identifiable information about you or your child to Kinderberry Hill is entirely up to you. You may decide not to submit to us personally identifiable information about you or your child to Kinderberry Hill, in which case Kinderberry Hill may not be able to provide certain services to you.
You may choose to prevent Kinderberry Hill from disclosing, storing or using your or your child’s personally identifiable information under certain circumstances (“opt out”). You may opt out of certain disclosure, storage or use of your or your child’s personally identifiable information for purposes that are incompatible with the purpose(s) for which it was originally collected or for which you subsequently gave authorization by notifying us by one of the methods at the end of this Privacy Policy, or by following the procedures set forth in an electronic communication from us, if applicable. There are some uses from which you cannot opt-out, such as our use, storage and/or disclosure of your or your child’s personally identifiable information in compliance with applicable laws, rules and regulations. As long as one or more of your children are students at a School, you also may not opt out of us using your children’s personally identifiable information to the extent reasonably necessary (in our sole discretion) for us to provide services to you and your children.
Access and Correction
To access your or your child’s personal information in the possession of Kinderberry Hill and correct inaccuracies of that information in our records, please contact us in the manner specified at the end of this Privacy Policy. We ask individuals to identify themselves and the information requested to be accessed and amended before processing such requests, and we may decline to process requests in limited circumstances as permitted by our then current business practices and/or applicable laws, rules and regulations.
Information from Children
Through the Website
The Website is not intended or designed to attract children under the age of thirteen (13). We do not use the Website to collect personally identifiable data from any person that we know to be under the age of thirteen (13) and we are in compliance with applicable privacy laws, rules and regulations. Notwithstanding anything in this Privacy Policy to the contrary, the sole circumstances under which we would knowingly receive personal information about a child through the Website are instances where the child’s School or parents/guardians provide that information.
Outside of the Website
Kinderberry Hill and our and their respective service providers, do receive information about your children as a part of offering and providing you and your children our services. By applying for enrollment or enrolling your child at a School, you expressly agree that such School and Kinderberry Hill, and our and their respective service providers, will necessarily receive certain personal information about and from your child. As a result of the foregoing described receipt and use of information about your child, you agree:
(1) This Privacy Policy shall serve as notice to you regarding our information practices with regard to children, including the types of personal information we may collect or receive from your child (through the Website or otherwise), the uses to which we may put that information, and whether and with whom we may share that information.
(2) You have and hereby consent to the collection of personal information from your child (in any manner, including, but not limited to, inadvertent or unauthorized disclosure through the Website).
(3) We have notified you that you have the right to request access to the personal information we at such time have collected from your child and the ability to request that such personal information be changed or deleted.
We do not currently engage in any marketing activities to your child through the Website. To the extent there is any change in the foregoing practice, such change will be posted to this Privacy Policy. To be clear, Kinderberry Hill treats privacy as a top priority, especially any information about your child.
You affirm that you are either more than eighteen (18) years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Privacy Policy, and to abide by and comply with this Privacy Policy. In any case, you affirm that you are over the age of thirteen (13), as THE WEBSITE IS NOT INTENDED FOR CHILDREN UNDER 13 WHO ARE UNACCOMPANIED BY THEIR PARENT OR LEGAL GUARDIAN.
Parents and legal guardians should be aware that Kinderberry Hill’s Privacy Policy will govern our use of personal data, but also that information that is voluntarily given by children or others in email exchanges, bulletin boards or the like may be used by other parties to generate unsolicited communications. By using the Website and/or enrolling your child at a school, you consent to the collection and use of information by us and our respective agents as specified above or as we or they otherwise see fit, in compliance with this Privacy Policy, unless you inform us otherwise by means of the procedure identified below. We may use comments, ideas, information, feedback or suggestions that you may submit in any manner that we may choose without notice or compensation to you.
